1. Agreement to Terms

By downloading, installing, accessing, or using PawFocus Cam ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and PawFocus Cam. We may update these Terms from time to time, and your continued use of the App after such changes constitutes acceptance of the updated Terms.

2. Description of Service

PawFocus Cam is a mobile application designed to help users capture high-quality photos and videos of their pets by providing attention-guiding features, including:

• Laser dot guidance system to attract pet attention
• Sound-based attention-guiding features
• Camera functionality for capturing photos and videos
• Various shooting modes and customization options

The App is available for iOS devices and requires iOS 15.0 or later. The App is designed for use with iPhone 12 and above.

3. Eligibility

You must be at least 13 years old to use PawFocus Cam. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You will not use the App for any illegal or unauthorized purpose

4. User Accounts and Registration

PawFocus Cam may not require user registration or account creation. However, if we introduce account features in the future, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5. Permissions and Device Access

To use PawFocus Cam, you must grant certain permissions on your device:

5.1 Required Permissions

• Camera Permission: Required for the core functionality of the App. Without this permission, you cannot capture photos or videos.

5.2 Optional Permissions

• Photo Library Permission: Recommended to save photos and videos captured with the App
• Microphone Permission: Optional, used only when you activate sound-based features

You can revoke these permissions at any time through your device settings. Revoking required permissions may limit or disable App functionality.

6. Acceptable Use

You agree to use PawFocus Cam only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable law or regulation
• Use the App to harm, threaten, or harass any person or animal
• Use the App to capture content without proper consent or authorization
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices or labels
• Interfere with or disrupt the App's functionality or servers
• Use automated systems or bots to access the App
• Copy, modify, or create derivative works of the App
• Use the App for commercial purposes without our written permission
• Share, distribute, or sell the App or any part thereof

7. Content and Intellectual Property

7.1 Your Content

You retain all ownership rights to photos, videos, and other content you create using PawFocus Cam ("Your Content"). You are solely responsible for Your Content and warrant that:

• You own or have the right to use Your Content
• Your Content does not violate any third-party rights
• Your Content complies with applicable laws

7.2 Our Intellectual Property

PawFocus Cam, including its design, features, code, graphics, logos, and trademarks, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written consent.

7.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use PawFocus Cam for personal, non-commercial purposes in accordance with these Terms.

8. Prohibited Content

You agree not to use PawFocus Cam to create, store, or share content that:

• Is illegal, harmful, or violates any law or regulation
• Infringes on intellectual property rights
• Contains hate speech, harassment, or discrimination
• Is defamatory, libelous, or invasive of privacy
• Contains explicit or adult content
• Promotes violence or illegal activities
• Contains malware, viruses, or harmful code

We reserve the right to investigate and take appropriate action, including reporting to law enforcement, if you violate this section.

9. Third-Party Services

PawFocus Cam may integrate with or link to third-party services, including:

• Apple App Store for downloading and updating the App
• Device operating systems and services
• Analytics and crash reporting services (if applicable)

We are not responsible for the content, privacy practices, or terms of service of third-party services. Your use of third-party services is subject to their respective terms and policies.

10. App Availability and Modifications

We strive to ensure PawFocus Cam is available and functioning properly. However, we do not guarantee that:

• The App will be available at all times or without interruption
• The App will be error-free or free from defects
• The App will meet your specific requirements
• Any errors will be corrected

We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We may also release updates, patches, or new versions of the App.

11. Disclaimer of Warranties

PAWFOCUS CAM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS

We do not warrant that the App will be uninterrupted, secure, or error-free, or that defects will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PAWFOCUS CAM, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF DATA OR CONTENT
• LOSS OF PROFITS OR REVENUE
• BUSINESS INTERRUPTION
• PERSONAL INJURY OR PROPERTY DAMAGE
• LOSS OF USE OF THE APP

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid for the App, or $0 if the App is free.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless PawFocus Cam, its developers, affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable law
• Your Content

14. Termination

We reserve the right to terminate or suspend your access to PawFocus Cam at any time, with or without cause or notice, for any reason, including if you violate these Terms.

You may stop using the App at any time by uninstalling it from your device. Upon termination:

• Your right to use the App will immediately cease
• All data stored locally on your device will remain on your device
• Provisions of these Terms that by their nature should survive termination will survive

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PawFocus Cam operates, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from or related to these Terms or the App shall be resolved through:

• Good faith negotiations between the parties
• Mediation, if negotiations fail
• Binding arbitration or litigation, as applicable under local law

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Providing notice through the App (if applicable)

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PawFocus Cam regarding the App and supersede all prior agreements and understandings.

19. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision. Any waiver must be in writing and signed by us.
